Family courts and district courts are open, and they are taking cases, but they are only hearing emergency cases during the lockdown, so a backlog is building up. If your case is not an emergency, there are a lot of people in front of you.
That is why it’s always so important to make sure that you are continually doing the right thing for your child. You want to make sure that you are prioritizing the wellbeing of your child and that you are documenting it. Because if you are doing the right thing, and the other party is not, there’s a chance that you can get priority in the line.
If you can show that there are impacts on your child; emotionally, socially, or developmentally, then it is possible for you to get in earlier under emergency protection orders for motions to restrict parenting time.
Remember, you always want to be documenting, and you want to get your evidence lined up beforehand. If it is an emergency, the courts are open. Otherwise, the courts will open to all cases eventually. It is just going to take longer.
